Press Release: EGL Revokes License of Israel Laboratory

Important Notice to all Members of the Diamond Industry and Trade in Israel

Press Release: The holders of the worldwide rights of EGL hereby notify you, the members of the Israel Diamond Exchange and all members of the diamond industry and trade, that on November 25, 2014, the license agreement with the gemological laboratory operated by Guy Benhamou (a former EGL laboratory that also uses the name EGL International), located in the Noam building in Ramat Gan, was revoked and canceled.

Upon termination of the license, as of that date, this lab is not authorized to issue certificates bearing the EGL trademark in any form whatsoever and/or represent the EGL brand.

Any certificate issued by this laboratory, including certificates bearing the name EGL International and/or the Internet address www.eglreports.org,  after this date is therefore a counterfeit report and the EGL trademark rights owners do not accept or regard such grading reports as reliable or credible.

Anyone making use of such reports is in violation of the rights of EGL, is misleading the public and exposes himself to a variety of charges, in particular legal procedures and criminal charges due to infringements of trademark laws and demands for compensation, and does so on his own accord with all the implications that this entails. The EGL trademark rights owners reserve the right to prosecute anyone who makes use of such reports.

In addition, the EGL rights owners announce that in spite of the fact that they own the majority of shares in the company holding the above laboratory,  Benhamou, while a minority shareholder, has taken control of the company and acts in it without their approval. The EGL rights owners also applied to the courts to dissolve the company.

The EGL trademark rights owners hereby let it be known that the only laboratory in Israel eligible to issue grading reports that carry the EGL trademark and logo is the EGC laboratory, which resides at Shoham 8, Ramat Gan.

B”H Important Notice to All Diamond Bourse Members Consequent upon yesterday’s notice with regard to prohibiting the use of EGL Certificates which are issued by EGL Laboratories Eurogem (Israel) Ltd., we wish to clarify unequivocally that the aforesaid notice is deceitful as it attempts by entirely improper means to harm our operations and cause us damage. We stress that our company has a long-term franchise agreement with EGL International to issue certificates in its name up until the year 2020 (with an option to extend the agreement for ten more years). This is a valid agreement which has never been nullified and continues to obligate both parties to the agreement on all its terms and clauses. Our company is authorized, without restrictions, conditions or prohibitions, to issue certificates under the name of EGL, as it has done for the past twenty-two years. Our company has met and continues to meet all the financial and professional franchise terms and conditions, and continues to provide reliable and professional service for its many customers. Any argumentation that pretends to present a different state of affairs from the aforementioned is to say the least inaccurate, and derives from the will of competing groups to achieve unfair profits at the expense of our company. The method of threating our customers merits total condemnation. It is unfathomable that members of the Diamond Bourse or groups connected with them should take advantage of the channels of information and communication between bourse members in order to threaten our customers on account of their lawful use of the EGL certificates that we print. These groups which attempt to harass us incessantly have failed in all their attempts up until now and have not managed to base one of their claims against us, this in spite of the fact that they have resorted to all ways and means of harming our operations. Hence, these groups are now attempting damage our long-term connections with clients by the use of threats and exposure to legal liability. One may understand the emotional state of these groups which, in spite of all their efforts, have realized that our laboratory is the most reliable and professional in the eyes of our all our clients, and in their limited capacity have chosen to resort to all means of slander, defamation, libel and futile threats in a desperate attempt to spoil our success. Needless to say, in spite of their extreme claims, these same groups have not turned to any legal institute, in the Diamond Bourse or in the court system, in order to prove their claims, as their demand for dismantling our company that is mentioned in their notice is without basis and was also submitted as part of their attempts to damage us. The professional and qualitative gap between our laboratory and the laboratory mentioned in the notice is known to all and is reflected in the operations of the two laboratories over the course of many years – a gap that the same laboratory thinks it can bridge by means of a slander campaign and attempts to inflict damage. Nevertheless, we trust that the members of the bourse will manage, as they have until now, to differentiate between the professional and personal advantages of our laboratory over the same failed laboratory. Our laboratory will continue to provide efficient, reliable, dedicated and professional service to all members of the Diamond Bourse in spite of all the attempts to impede our operations and harm us.
