David Yurman Wins Counterfeiting Case

RAPAPORT... A New York district court has granted jeweler
David Yurman protection against websites selling counterfeit
merchandise under its brand.
Judge Paul Oetken issued a permanent injunction against 31
unnamed websites, preventing them from distributing, advertising or selling any
fake David Yurman products, the jeweler said last week. He also awarded the
jeweler nearly $1.6 million in statutory damages, and ordered the defendants to transfer the domain names of all infringing websites to David Yurman.
The defendants operated a network of websites that were
designed to look like authorized David Yurman sites, using the retailer’s
trademarks and copyrighted campaign images, according to a statement by the company.
They then sold imitation products using the jeweler’s name. “We are pleased with the judgment, and will continue to take
aggressive action to protect our consumers, our designs and our trademarks,”
said Carol Pennelli, president of David Yurman. “We will not tolerate infringers
and counterfeiters in the marketplace, regardless of where they operate.”
